Necesidad de poner fin a la procrastinación de la modificación del modelo de administración de la justicia de menores en Cuba

The investigation addresses the need to modify the model of administration of juvenile justice in Cuba, which dates back to 1982 and still contains features of the guardianship system applied to minors who are not criminally responsible. This is based on Cuba’s ratification of the Convention on the Rights of the Child and the much-needed transition towards a model grounded in responsibility and legal guarantees. Likewise, the study reflects on the importance of ensuring uniformity in the treatment of minors, proposing the elimination of the use of undifferentiated criminal law for those under eighteen and over sixteen who are criminally liable, according to the provisions of Cuban criminal law.
