Dziecięcy influencerzy w prawie polskim a rządowy projekt ustawy o zmianie niektórych ustaw w celu ulepszenia środowiska prawnego i instytucjonalnego dla przedsiębiorców (UD 497)

This article deals with the problems of properly regulating activities of minor influencers (kid influencers), i.e., children with a large number of followers on social media who exploit popularity for commercial purposes. States are considering protective measures for minors in terms of remuneration and safe working conditions to limit the risk of exploitation and violations of personality and privacy. This may interfere with the constitutional right of parents to raise their children in accordance with their own beliefs and to direct their actions. The article also refers to the Governmental Bill on Amending Certain Laws to Improve the Legal and Institutional Environment for Entrepreneurs of 10th July 2023. In the authors’ opinion, the current regulations are insufficient, as is the bill, which addresses a narrow aspect of the issue without solving most of the problems and even generates further ones.
