Problems of legal regulation of the transition of medical organization to maintaining medical documentation in the form of electronic documents, requiring immediate solution.
Today, the most important state task is the transition of the Russian healthcare system to maintaining medical records in the form of electronic documents. In this regard, the authors draw attention to the fact that the currently valid Procedure for organizing a document management system in the form of electronic documents, approved by Order of the Ministry of Health of Russia dated September 7, 2020 N947n, does not contain provisions obliging medical organizations to switch to maintaining medical records in the form of electronic documents, does not contain information on the timing of such a transition, and does not contain a mandatory minimum of medical documents that must be maintained in the form of electronic documents. Since the legislation in the field of healthcare does not have an approved concept of «medical documentation», the authors proposed their own version of the concept of «medical documentation» to enshrine it in the Federal Law of November 21, 2011 N323-FZ «On the Fundamentals of Protecting the Health of Citizens in the Russian Federation». The article substantiates and presents detailed proposals for the Russian Ministry of Health to amend the order of the Russian Ministry of Health dated September 7, 2020, No. 947n. The article substantiates and proposes the end of 2030 as the official deadline for completing the main work on the transition of Russian healthcare to maintaining medical records in the form of electronic documents.
