Lessons from the review of judicial practice in the compulsory health insurance system. Part 2. Issues of misuse of compulsory medical insurance funds in the provision of medical care, including high-tech.

The article is devoted to the problems of misuse of compulsory medical insurance funds, which were considered in the “Review of Judicial Practice in cases related to the application of legislation on compulsory medical insurance” published by the Supreme Court on 11/27/2024 (hereinafter referred to as the Review). At the same time, the materials of the publication go beyond the scope of the Review, affecting the regulatory framework for recognizing expenditures as targeted or non–targeted, as well as its recent changes, which, in some cases, reduce the number of grounds for recognizing expenditures as non-targeted, while in others, on the contrary, create new risks of interpreting expenditures as non-targeted. The study also examines a wide range of other court cases on the misuse of compulsory health insurance funds, as well as new trends in judicial practice, when courts reduce fines for misuse of funds, etc.
