বশষজঞ আলমদর দষটত ‘আহলল হলল ওয়ল আকদ’: পরক-আধনক ও আধনক সময়র আলক একট বশলষণ| ‘Ahl al-Ḥall Wa al-ʻAqd’ in the View of Esteemed Scholars: An Analysis in the Light of Pre-Modern and Modern Times

As part of the scheme of Islam to resolve the complexities of various spheres of human life, the importance of authoritative, universally acceptable and knowledgeable persons well versed in the Qur’an and Sunnah to offer crucial decisions has been recognized in the society. In the eyes of learned jurists, this section of Muslim society is mainly considered as ‘Ahl al-Ḥall Wa al-ʻAqd’. The term has been reflected in the writings of expert Muslim jurists, Jurisprudents (scholars of Principles of Islamic Jurisprudence), thinkers and theorists at different times in multifarious ways. Moreover, this very term has undergone changes over time. This important term, widely used in Islamic Shariah, remains almost unspoken in Bangla (Bengali) language. Keeping the aforesaid reality in mind, this article, written in a descriptive and analytical manner,has demonstrated that modern Muslim scholars are revisiting the understanding of pre-modern thinkers about the ‘Ahl al-Ḥall Wa al-ʻAqd’ to a greater extent. Furthermore, the author has maintained that it is quite complex and difficult to reconcile the ideological differences and distances that have arisen between Muslim scholars of two different times and realities around this term. সারসংক্ষেপ : মানুষের যাপিত জীবনের বিভিন্ন স্তরের জটিলতা নিরসনে ইসলামের যে নির্দেশনা বিদ্যমান, তারই অংশ হিসেবে গুরুত্বপূর্ণ সিদ্ধান্ত গ্রহণের ক্ষেত্রে কুরআন-সুন্নাহতে সমাজের কর্তৃত্বশীল, সর্বজনীন গ্রহণযোগ্য ও জ্ঞানী ব্যক্তিদের প্রয়োজনীয়তাকে স্বীকৃতি প্রদান করা হয়েছে। বিদগ্ধ আলেম ও ফকীহদের দৃষ্টিতে, মুসলিম সমাজের এই অংশটিই মূলত ‘আহলুল হাল্ল ওয়াল আকদ’ হিসেবে বিবেচিত। উক্ত পরিভাষাটি বিভিন্ন সময়ে বিশেষজ্ঞ ফকীহ, উসূলবিদ, চিন্তাবিদ ও তাত্ত্বিকদের লেখনীতে বহুমাত্রিকভাবে ব্যবহৃত হয়েছে। সেই সাথে এই পরিভাষাকেন্দ্রিক চিন্তাধারাও সময়ের সাথে সাথে পরিবর্তিত হয়েছে। ইসলামী শরীয়তে ব্যাপকভাবে ব্যবহৃত এই গুরুত্বপূর্ণ পরিভাষাটি বাংলা ভাষায় প্রায় অনুচ্চারিত রয়ে গেছে। এই বাস্তবতাকে সামনে রেখে বর্ণনামূলক ও বিশ্লেষণমূলক পদ্ধতিতে আলোচ্য প্রবন্ধটি রচিত হয়েছে। বক্ষ্যমাণ প্রবন্ধে দেখানো হয়েছে যে, প্রাক-আধুনিক বিশেষজ্ঞ আলেমদের ‘আহলুল হাল্ল ওয়াল আকদ’ নিয়ে যে বোঝাপড়া ছিল, আধুনিক সময়ের মুসলিম স্কলারগণ তার অনেক কিছুই পুনর্বিবেচনা করছেন। একই সঙ্গে, বক্ষ্যমাণ প্রবন্ধে এই চিন্তাগত পার্থক্যের মূল উৎস অনুসন্ধান করার চেষ্টা চালানো হয়েছে। প্রবন্ধের মাধ্যমে এটাও স্পষ্ট হয়েছে যে, উক্ত পরিভাষাকে কেন্দ্র করে দুটি ভিন্ন সময় ও বাস্তবতায় অবস্থানকারী মুসলিম মনীষীদের মাঝে যে চিন্তাগত পার্থক্য ও দূরত্ব তৈরি হয়েছে, সেগুলোর সমন্বয় সাধন যথেষ্ট জটিল ও দূরূহ।
