Islamic Inheritance Rights for Women in Pakistan: Exploring Legal Safeguards and Social Challenges

Despite the safeguards provided by both Sharia law and Pakistan's constitution, the denial of women's inheritance rights remains widespread in Punjab. This study focuses on examining women's inheritance rights under Islamic family law, particularly in the context of Pakistan. The purpose of this research is to investigate the reasons behind women surrendering their inheritance, as well as the difficulties and obstacles they typically encounter throughout the process. Additionally, the paper explores the choices available to women and the challenges they face when trying to exercise these choices independently. Data was collected through in-depth interviews. The data was analysed by using thematic technique. Findings reveal that, despite the existence of fair laws under Islamic Sharia, Muslim women continue to encounter significant barriers in exercising their inheritance rights. Key factors include lack of awareness, societal and familial pressures, and cultural norms that compel women to forgo their entitlements.
