On Actualizing the Use of the Judicial Reconciliation Institution

The article justifies the expediency of transferring the function of maintaining a list of judicial conciliators to the bodies of the judicial community — the Councils of judges of the constituent entities of the Russian Federation. To ensure the availability of judicial reconciliation, it is proposed to establish the subject-territorial competence of judicial conciliators. As an alternative to the introduction of compulsory judicial reconciliation in certain categories of cases, it is proposed to give the judge the right to independently direct the parties to an information meeting with the judicial conciliator. It is necessary to include in educational programs for advanced training of judges, court staff, lawyers and other persons providing legal assistance, sections on the procedure for judicial reconciliation with the involvement of judicial conciliators in the conduct of classes.
