THE DOCTRINE OF V.F. TARANENKO ON THE ADVERSARIALITY PRINCIPLE OF OBJECTIVE TRUTH IN THE LIGHT OF INTER-GENERATIONAL SOLIDARITY

The article is devoted to the analysis of the essence of the principles of adversarial proceedings and objective truth reflected in the works of V.F. Taranenko, as well as to the identification of the peculiarities of their implementation in the consideration and resolution by arbitration courts of cases involving a potential conflict of interests of the present and future generation. The author reveals the concept of the principles of intergenerational and economic solidarity enshrined in the Constitution of the Russian Federation, as well as assesses the impact of these provisions on the process of making a court decision on the case.
