On the Feasibility and Efficiency of Emphyteusis Use in the Russian Civil Law

The article analyzes the possibility of implementing emphyteusis in Russian civil law. Based on the sources of Roman and pandect law, the author substantiates the purpose of emphyteusis, namely the right of emphyteusis to a land plot for agricultural needs and land processing. The author proves the effectiveness of the institute of emphyteusis in Russian civil law, based on these provisions, possibly subject to the mutual interest of the state, legal entities and citizens in the processing of land plots, the provision by the state of appropriate benefits for the acquisition of the right of emphyteusis to a land plot.
