A RESPONSABILIZAÇÃO DA INTELIGÊNCIA ARTIFICIAL DIANTE DE DANOS CAUSADOS POR VEÍCULOS AUTÔNOMOS
This study aims to present legal rules on liability for damages caused to third parties in accidents involving automated cars, since autonomous vehicles have a system equipped with artificial intelligence, and, depending on the level of automation, do not require human direction. With this focus, this study aims to analyze the possible repercussions of civil and consumer liability in accidents involving autonomous intelligent vehicles, analyzing the objective liability of the manufacturer or the subjective liability of the owner, exploring the perspective of artificial intelligence, explaining the expectations, levels of self-sufficiency, possible failures and accidents of autonomous cars and their effects also within consumer legislation, clarifying the liability in the event of damage in Consumer Law, as well as the application of the Civil Code. It will also bring arguments on regulatory needs, describing the problems and legislative challenges, and the needs for implementing public policies. The methodology used to prepare the report was a systematic literature review, with references to books, doctrines, case law, summaries, the Federal Constitution, the Consumer Protection Code and the Civil Code. The results showed that manufacturers should promote preventive and energetic strategies, seeking to avoid accidents resulting from the consumption of their technologies and linking ethical principles to be assumed by the equipment, since artificial intelligence has a great impact on the legal sphere. Furthermore, it is of utmost importance to develop specific regulations in order to ensure the activity explored, as well as the rights of consumers and third parties.
