The concept of the social function of the state

This paper aims to clarify the concept of the state’s social function. Through an analysis of scholarly approaches to the definitions of “function,” “state functions,” and “social function,” the author establishes the content of the term “social function of the state.” It is argued that, in a modern context, the social function is the primary, purpose-driven, and integrated direction of state influence on social relations, governed by legal frameworks. This influence is shaped by the state’s legally established social objectives, aligned with foundational legal principles, and is executed by authorized entities who perform this social role within defined forms and using specific methods. The overarching aim of this state-directed influence is to secure a suitable level of social security for all individuals and citizens. The author identifies several distinctive features of the state’s social function. First, this function is guided and defined by current Ukrainian legislation, which ensures alignment with the legal principle codified in Part 2 of Article 19 of the Constitution of Ukraine. This legislative basis secures coherence in the actions and decisions that bring this function into effect, emphasizing adherence to the principle of legality. Secondly, the social function embodies a systematic and goal-oriented influence on social relations, impacting the individuals and groups involved in these relations. This influence is realized through the coordinated actions and decision-making processes of authoritative entities, specifically tailored to address social concerns and objectives. The author further elucidates that the social function of the state, as a directed influence on social relations and their participants, is closely aligned with the execution of socially oriented objectives. This functional alignment enables those charged with implementing the state’s social function to fulfill its overarching purpose. Additionally, the social function inherently requires a dynamic and active expression in tangible reality, materializing through the coordinated actions of designated actors. This dynamic manifestation occurs in specific, structured forms, utilizing particular methods and tools tailored to address the challenges inherent in executing the state’s social function. Thus, the practical realization of this function reflects a systematic approach in both form and application, addressing defined social issues through targeted actions and decisions.
