Negative social consequences and legal mechanisms to limit the involvement of military personnel and vulnerable categories of society in gambling

The article examines the current state of legal regulation of gambling activities, taking into account the presence of relevant, socially significant problems and the negative consequences of the latter in the form of involvement in these processes, in particular, military personnel. The article is a continuation of research aimed at developing proposals for the development of legal mechanisms and amendments to legislation to restrict participation in gambling by certain categories of society, which allow ensuring effective observance of the balance between the free existence of gambling, in particular online casinos, and rational restrictions on participation in them. It has been determined that negative social consequences in the form of gambling addiction require the adoption of comprehensive measures with a positive impact on the individual and society as a whole through the need to establish certain legal restrictions on the participation of game participants in online casinos and the introduction of effective legal advertising standards. As a result of the review of the current state of legal regulation, it was established that the existing restrictions are of a general nature and the only effectively controlled restriction is the player’s age. At the same time, such restrictions do not take into account the belonging of a potential participant in gambling to a vulnerable social category, in particular military personnel, or the ability of such a person to spend significant amounts of income on gambling. Taking into account the comprehensive approach to solving this problem, legal means also include regulating the advertising market, especially on the Internet, more stringent regulation of the activities of gambling organizers, establishing sanctions for violations of the law, and strengthening control over their activities. The proposed proposals concern the establishment at the legislative level of restrictions on a person’s participation in gambling only at the expense of a certain part of the legal declared income and the introduction of an electronic player’s account, which would perform the functions of access and control over consumers and organizers of gambling. Such changes will allow for the automatic introduction of restrictions on gambling not only for military personnel, but also for a predetermined circle of persons who need it.
