Legal problems of greening agriculture in the light of the sustainable growth strategy: current status and prospects
The article is devoted to a deep and comprehensive study of the legal problems of greening in the agricultural sector and the analysis of modern approaches to environmental management in agriculture. The author has studied the concept of «sustainable agriculture» and its features, and also considered the question of why greening is currently an important component of sustainable agriculture. There is considered legal issues regarding the implementation of the concept of greening in Ukrainian legislation. In particular, in the context of land protection in agriculture and the regulation of organic agriculture. The modern directions of greening, which are being implemented in Western countries and gradually becoming relevant for Ukraine, are analyzed. We are talking about organic agriculture, conservation agriculture and agroforestry. It has been established that agroforestry is one of the effective examples of greening agricultural activities in farm conditions. The author analyzes the latest changes in the legislation of Ukraine (Land Code of Ukraine, Law of Ukraine “On Basic Principles and Requirements for Organic Production…”), which provide for new mechanisms for the greening of agricultural activities – such as certification, land certification, creation of eco-landscapes in farm conditions, etc. They are modern methods of greening, which are gradually beginning to be implemented in the agricultural sector in Ukraine, but there is still no perfect mechanism for their regulatory and legal regulation. This article also analyzes individual legal acts of European legislation that highlight the issues of greening and determine the scope of its application. The author offers some important proposals and recommendations for supplementing individual provisions of the Law of Ukraine “On Land Lease”, the need to develop rules that will determine the procedure for implementing agroforestry as a promising direction of agricultural activity in Ukraine. The need to approve the procedure for certification of agricultural lands intended for organic production is established.
