This is a literature review, using bibliographical research, as well as an analysis of the jurisprudence of the Federal Supreme Court, highlighting the decision of non-compliance with fundamental precept 976 judged in 2023. The research demonstrated that a structural bias is necessary so that the decision does not just remain on paper and has real effectiveness, it is not enough to recognize the obligation to implement public policy, a model is needed that faces this problem, promotes rights and overcomes the barrier of invisibility of people living on the streets.
