IMPLEMENTING CONSTITUTIONAL COURT DECISIONS: CASE STUDY OF THE REVISION OF THE 2024 REGIONAL HEAD ELECTION LAW IN INDONESIA
This study examines the role and function of the Indonesian Constitutional Court (MK) in the constitutional system, focusing on the judicial review process and the challenges of implementing its decisions. This study uses a case study of Constitutional Court decision no. 60/PUU-XXII/2024 and No. 70/PUU-XXII/2024 regarding the revision of Law No. 10 of 2016 concerning Regional Head Elections. Even though the Constitutional Court’s decisions are final and binding, their implementation often faces obstacles due to political dynamics and limited enforcement mechanisms. This can be seen from the attitude of the People’s Representative Council (DPR), which ignored some of the Constitutional Court’s decisions during the plenary meeting on revising the law. The paradox between the principle of constitutional supremacy and political reality shows that the successful implementation of MK decisions depends on coordination between state institutions and public understanding. This study highlights the importance of strengthening check and balance mechanisms and increasing constitutional awareness to ensure the effectiveness of the Constitutional Court’s role in maintaining the integrity of the Indonesian constitutional system.
