Minors’ criminal liability - procedure and conditions for performance
Contraventions, considered precursors to the increase in the crime phenomenon, represent illegal acts with a lower degree of social danger than crimes, but which, however, violate the social values protected by law. A complex study dedicated to the contraventional phenomenon, through the lens of the subject of liability - the minor, was not carried out, being more than necessary to carry it out, or, anticipating through knowledge how things can evolve, from a correct behaviour to a contraventional one, and, subsequently and in a criminal one we can stop it at the initial stage. It is important to ask ourselves what the root causes of these behaviours are and how we can intervene at their level to prevent their recurrence in the future. The contraventional code determines that the examination of contraventional cases regarding minors is the competence of the court, even if they are found and documented for the most part by the Police. Likewise, in the contravention procedure, the measures and sanctions applicable to minors are milder than to adults.
