Verdade e método da linguagem simples: Uma proposta hermenêutica de inovação jurídica
This paper proposes a reflection on new linguistic expressions resulting from digital innovations and their transformative impacts on Law. The authenticity of the dialogical discourse method present in Hans-Georg Gadamer’s Truth and Method was used as an appropriate framework for the expository approach employed in this article. Based on this, the research aims to explore the adjustments and enhancements of legal language through the use of Plain Language as a necessary foundation to strengthen the exercise of democracy in the digital age. The primary objective, therefore, is to identify the hermeneutic purpose that language simplification movements have adopted in defense of the right to understand and the resulting openness to active societal participation in the development of these new practices. Through dialectical-deductive methods, parameters regarding the truth behind discourse were discovered, as well as contributions from other sciences to address potential regulatory command flaws. This study seeks to demonstrate that, beyond an idealized objectivity pursued by a functional language method, there are substantial issues that have been consolidated due to naturally formalistic practices of linguistic eccentricities, which are now undergoing adaptations due to technological advancements.
