ABOLISHING THE CONSTITUTIONAL COURT’S ROLE AS POSITIVE LEGISLATURE: A PRELIMINARY STUDY

This article discusses the issue of abolishing the role of the Indonesian Constitutional Court as a positive legislature in exercising judicial review jurisdiction. This issue is very relevant because it is related to the most controversial recent decision from the Constitutional Court, namely Constitutional Court Decision Number 90/PUU-XXI/2023. This article proposes to abolish the Constitutional Court’s positive legislature role. This role is very dangerous because it is prone to abuse, as occurred in Constitutional Court Decision Number 90/PUU-XXI/2023 which then caused a very wide controversy in the nomination of Gibran Rakabuming Raka as candidate of vice president in the 2024 elections. The argument used here is that the practice of judicial review by the Constitutional Court must be disciplined based on the principle of separation of powers. Based on the principle of separation of powers, the role of the Constitutional Court must be limited according to its original jurisdiction as a negative legislature. The role of the Constitutional Court as a positive legislature is contrary to the principle of separation of powers because it usurps the traditional role of law makers, namely the People’s Representative Council and the President.
