Rules for Arbitration In Disputes Trademarks According to the Jordanian Arbitration Law TRIPS Agreement to Achieve Sustainable Development Goals
Objective: The study aimed to identify Rules of Arbitration in Trademark Disputes and the Convention (TRIPS) To achieve sustainable development goals. Theoretical Framework: There has been a significant development during the previous years in matters related to arbitration rules in trademark disputes by international agreements and treaties such as the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Method: The study used descriptive, analytical and comparative scientific research methods. Results and Discussion: The study found that issues related to arbitration rules in trademark disputes have developed; there are strict laws that protect the trademark rights of individuals and companies and provide civil and criminal legal protection for them. Also, the protection of a legally well-known trademark constitutes an exception to two basic principles, namely the principle of territoriality and the principle of specialization. Research Implications: The increase in recourse to the judiciary to resolve disputes between individuals led to the accumulation of cases before the courts and slowed down litigation procedures, so the judiciary is no longer an effective means of requiring rights but has become in certain cases a field for delay and disruption, so it was necessary to find an alternative to resolve these disputes, which is arbitration. Originality/Value: The system of arbitration of trademark disputes was established, and independent provisions were enacted because of its positive impact on encouraging domestic and international trade and investment, which has a positive return on the economies of countries.
