Good Legislative Scrutiny Enhances the Clarity and Effectiveness of the Law. Do You Agree?
Good legislative scrutiny, which involves technicality and accountability, does enhance the clarity and effectiveness of law but with exceptions. Australia's Fair Work Act (2009) proves that good legislative scrutiny leads to ‘good laws’. In the same way, the Dangerous Dogs Act (DDA) (1991) proves that lack of scrutiny leads to ambiguous and ineffective laws. Pre-legislative scrutiny is key in resolving ambiguities by examining the language and incorporating expert and public opinion. Post-legislative scrutiny makes the law more effective by evaluating its implementation and the achievement of its intended purpose. DDA is an example where post-legislative scrutiny resolved most concerns with the original legislation, especially the lack of consideration of potential issues and stakeholder interests.
