El derecho fundamental a las medidas cautelares
The effectiveness of judicial proceedings very often depends on precautionary measures. Without timely and suitable judicial intervention, the situations claimed before the courts could unlawfully harm the parties or other persons in a serious or irreparable way and could even prevent the enforcement of the judgment. With this premise, this article asserts the existence of a constitutional right for the judge to broadly and generally order the necessary measures to provisionally protect the parties—and even other subjects—during the process, and thus provide them with a prompt and effective justice.
