Regarding the use of verification method in the process of investigating and disclosing criminal offenses
The article studies the unconventional psychological method of verification, which has recently been effectively used in the process of investigating and disclosing criminal offenses. It is determined that the use of psychological knowledge is of an auxiliary nature, but it allows to increase the effectiveness of establishing psychological contact with participants with different categories of persons participating in the pre-trial investigation, to expand the practical capabilities of the investigator in obtaining objective information and detecting lies, which will help in identifying the guilty and disclosing the criminal offense. Among such methods, the most effective are profiling and verification ones, which are successfully used in their practical activities by individuals with specialized knowledge. It has been proven that in criminal proceedings, the use of data verification technology obtained by verbal and non-verbal means contributes to the reliability and timeliness of diagnostics of the informational and psychological state of its participants, promotes the establishment of further emotional contact with them, helps to identify their real state, involvement in the criminal offence. If a law enforcement officer carrying out investigative actions has special verification skills, he will be able to recognize the tricks of interested persons, lies, various methods of staging and falsification. Based on the specifics of the task set before the verifier, this technique is used in the process of questioning (spoken/unspoken), interrogation, face-to-face interview, search, verification of testimony on the spot, and other investigative actions. At each stage of criminal proceedings, the verification mechanism has its own characteristics. It is determined that the choice of a specific method of data verification by a law enforcement officer is determined by specific circumstances that are subject to establishment in criminal proceedings. To choose a method of verification of non-verbal information in criminal proceedings, a law enforcement officer must conduct a conversation with a person (persons) on various topics to establish psychological contact, investigate the psycho-emotional individual characteristics of the person’s behavior, communication in various spheres of life, etc. The specifics of conducting such lengthy conversations depend on the essence, type and purpose of a particular procedural (investigative) action; the subject of study; the procedural status of the person and the degree of his or her involvement in the criminal offense; the psycho-emotional state, individual intellectual characteristics of the law enforcement officer, etc. The author agrees with the opinion of the famous psychologist P. Ekman that in the process of studying the veracity of testimony, it is necessary to analyze such signals of emotions as: facial expression; voice; impulses to physical action, including gesticulation; manifestations of the autonomic nervous system. It has been proven that the use of special verification knowledge in pre-trial investigation of criminal proceedings allows determining the degree of correspondence of the information reported by a person to the objective reality, assessing his behavior, and developing an effective strategy for conducting investigative actions and rapid disclosing a criminal offense.
