Capital, câmbio, investimento e a legislação sobre mercado de câmbio no Brasil

This article seeks to contribute to the analysis of the adequacy of Law 14,286, of December 29, 2021, to the national legal system and, in particular, to article 172 of the Constitution of the Federative Republic of Brazil of 1988 based on the definitions of capital and investment, the forms of application of foreign capital in national territory previously regulated by Law 4,131, of September 3, 1962, and the guidelines of the Liberalization Codes of OECD, to which the new legislation on the foreign exchange market and the legal discipline of Brazilian foreign investment were definitively adapted with the approval of Law 14,286, of December 29, 2021.
