ON MEASURES OF PENAL RESPONSE TO CHANGES IN THE PUBLIC DANGER OF THE PERSONALITY OF CONVICTS SERVING IMPRISONMENT

One of the features of the branches of legislation of the criminal cycle of the post-Soviet period is the purposeful reduction of the classification categories of those sentenced primarily to imprisonment. As a result, a number of types of correctional institutions were abolished, and the established criteria for the classification (separation) of convicts changed. The legislator needs to take into account new problems that objectively arise in the process of development of the state and society, and resolve them in a timely manner. The special military operation conducted by Russia in Ukraine requires an immediate proactive response to possible excesses while serving a sentence of imprisonment by convicts who previously participated in hostilities on the side of Ukraine. It can be assumed that joint detention in the same institution with convicted Russian citizens may provoke the commission of crimes based on political, national, linguistic, gender and religious identity, as well as revenge motives. To prevent such a development of events, it seems necessary to single out such a classification category of convicts as members of nationalist armed formations who participated in hostilities against our country, foreign mercenaries and military personnel of the Armed Forces of Ukraine, providing for their separate maintenance from other convicts of the Armed Forces of Ukraine, providing for their separate maintenance from other convicts.
