A viagem redonda: a Lei nº 14.133/2021 e o resiliente problema das normas gerais em licitações e contratações públicas

The article examines the complex and challenging issue of general rules in the New Public Procurement Act, using the figure of contracting agents as a case study. Based on the constitutional premise that, in matters of public procurement, the Union is only responsible for legislating general rules, the author revisits decisions of the Supreme Federal Court to argue that the New Act established specific rules regarding contracting agents, encroaching on the competence of states and municipalities.
