Application of the provisions of the Act of 8 March 2013 on the prevention of undue delay in commercial transactions to insurance contracts

This article is based on the decision of the Court of Justice of the European Union in case C-303/23, PZU S.A. v. Volvia. In this case, the Court unequivocally recognized an insurance contract in which the policyholder was an entrepreneur as a commercial transaction within the meaning of Directive 2011/7/EU. Thus, it prejudged the applicability of the Act of 8 March 2013 on Prevention of Excessive Delay in Commercial Transactions to similar factual situations as in the present case. The article explains the most important legal issues that relate – in the context of the application of the Act – to insurance contracts.
