The incorporation of artificial intelligence systems into healthcare products and services is revolutionising the world of medicine. The effectiveness of these advances depends, to a large extent, on the existence of a regulation that guarantees fundamental rights and is capable of delimiting the non-contractual liability that must be demanded for damage caused by health products and services that incorporate artificial intelligence systems, and of identifying the liable parties. This paper studies the existing possibilities for the enforcement of this liability and the recently approved European regulation to this effect.

Abstract

The incorporation of artificial intelligence systems into healthcare products and services is revolutionising the world of medicine. The effectiveness of these advances depends, to a large extent, on the existence of a regulation that guarantees fundamental rights and is capable of delimiting the non-contractual liability that must be demanded for damage caused by health products and services that incorporate artificial intelligence systems, and of identifying the liable parties. This paper studies the existing possibilities for the enforcement of this liability and the recently approved European regulation to this effect.
