Pravo na obrazovanje: Izazovi budućnosti kroz judikate Europskog suda za ljudska prava

Education and its reforms have recently entered the focus of political debates. Legislative steps are present, but there is still no de facto realization. Nevertheless, every democratic state is responsible for managing the education system in accordance with the principle of a good steward, ensuring the availability of all levels of education both in terms of space, time, and finances. Legislators undertake activities aimed at affirming the general right to education, equal access to education, prohibition of any form of discrimination and inequality in education, etc. The authors will primarily analyse the jurisprudence of the European Court of Human Rights (hereinafter: ECtHR) to show the extent to which the Republic of Croatia and the Republic of Serbia contributed to the true implementation of the full and general right to education by taking legislative, administrative, institutional and other measures. The secondary goal is to briefly compare the educational legislation in the Republic of Croatia with the legislation in the Republic of Serbia. The comparative legal presentation provides an insight into the similarities and differences between the legal regulations, and historical belonging to the same country, considering the common tradition and standards of a particular branch of law, is a logical reason for taking the Croatian and Serbian legislation as a model.
