Thical Oversight and Judicial Independence in Fulfilling SDG 16: a Historical, Conceptual, and Comparative Analysis
Objectives: This study aims to elucidate the essential nature of ethical oversight in the judiciary and how it influences the exercise of judicial power within a democratic constitutional state. Theoretical Framework: Anchored in the principles of constitutional democracy, judicial independence requires freedom from external pressures—be they political or economic—and aligns with Sustainable Development Goal (SDG) 16 on “Peace, Justice, and Strong Institutions.” Method: A descriptive approach is employed, integrating historical, conceptual, and comparative methods. Deductive and inductive reasoning guide the analysis of primary and secondary sources, ensuring that conclusions are scientifically verifiable. Results and Discussion: Findings reveal that a truly independent judicial system arises when judges possess two critical attributes: (1) a high level of expertise in their field and (2) strong personal integrity. Ethical justice, maintained through consistent oversight, fosters public trust and upholds fairness and dignity in judicial proceedings. Comparative insights demonstrate that robust ethical frameworks and accountability measures across jurisdictions significantly contribute to sustaining impartial and credible courts. Research Implications: These results underscore the importance of reinforcing judicial ethics through clear regulatory standards and ongoing professional development. By doing so, public confidence in the rule of law is bolstered, advancing broader democratic values. Originality/Value: Through an integrated historical, conceptual, and comparative lens, this study highlights the pivotal role of ethical oversight in safeguarding judicial independence. Its findings contribute to the discourse on legal reform and underscore the necessity of aligning ethics with institutional integrity—key factors for achieving the objectives of SDG 16.
