WELFARE CONCEPT OF LABOR IN THE PERSPECTIVE OF MAQASHID SHARIA

The condition of employment worldwide has always presented complex and unresolved issues. High unemployment rates, labor welfare problems, employment contracts, and terminations are among the prevalent challenges. Nearly every sector acknowledges that laborers face unjust conditions, exacerbated by the Omnibus Law on Job Creation, which is seen as overly favorable to employers and detrimental to workers' welfare. Consequently, many workers, academics, and practitioners have opposed the enactment of this law. In line with Islamic principles, workers' rights should be justly compensated to enable them to achieve worldly prosperity without undue suffering. In Islam, welfare serves as both a goal and a principle toward achieving Sharia (Maqashid Sharia). The aim is to attain benefits for individuals and communities, ensuring a complete life in this world and the hereafter. This research employs a qualitative method with a literature review approach, examining works concerning labor welfare and Maqashid Sharia. The findings indicate that Islam regards all as equals, distinguished only by their level of piety toward Allah SWT. According to Jamaluddin Athiyyah's perspective on Maqashid Sharia, the welfare of laborers is highlighted within several points, including the protection of honor (Hifdz al-‘Irdli), social justice (Iqamat al-‘Adl), mutual recognition, support, and complementarity efforts, as well as the state's obligation to protect human rights. Therefore, respecting human dignity should be paramount in work activities. By ensuring labor rights are equal to those of employers, justice can be achieved without oppression.
