The right to equality in the face of prioritization criteria in the payment of judicially recognized debts

This study analyzed the impact on the right to equality in Law 30137, which establishes prioritization criteria for the payment of judicial rulings in the education sector of the Cajamarca region in Peru. The research follows a qualitative approach with a narrative and interpretative design. The study population consisted of the Committee for the Preparation and Approval of the Payment List of the Regional Government and the Legal Advisors of the Local Educational Management Units in the region. The research employed interviews and document analysis as data collection techniques, using an interpretative method. The findings reveal that the cited law includes prioritization criteria that do not allow all creditors to have the same payment opportunities, resulting in a verifiable inequality that affects individuals' social rights.
