Disparitas Norma Nafkah Iddah dalam Kompilasi Hukum Islam: Perspektif Mashlahah Mursalah untuk Kepastian Hukum Pascaperceraian

Iddah maintenance is a legal consequence of divorce that must be fulfilled by the husband. Article 149 KHI limits iddah alimony to the wife only when divorce occurs at the initiative of the husband (cerai talak), but if the divorce occurs at the initiative of the wife (cerai gugat) the wife is not entitled to iddah alimony. However, Article 152 KHI regulates iddah maintenance as the right of a divorced wife unless the wife is nusyuz, without classifying the form of divorce. This study aims to analyze the shar'i reasons related to articles 149 and 152 KHI based on maqasid shari'ah theory. This study is a normative type of study using KHI as primary legal material, and using reference books, journals, and research results as secondary legal material. Data analysis is done qualitatively. The results of the study show that the disparity in norms related to iddah maintenance as a post-divorce wife's right causes legal uncertainty and based on mashlahah mursalah theory, Article 152 provides more benefit. Revision of Article 149 KHI is needed to realize legal certainty in the context of the legal consequences of divorce.
