ACERCA DE LA ATRIBUCIÓN DE CONDICIÓN CONSUMIDORA A LAS PERSONAS JURÍDICAS Y A OTROS ENTES CARENTES DE PERSONALIDAD
As can be inferred from the title of this paper, we propose to analyse the problems inherent in the attribution of consumer status to legal persons and other entities lacking personality, which is the legislative policy option our legislator has opted for in the Consolidated Text of the General Law for the Defence of Consumers and Users when it comes to offering a legal concept of consumer. The matter is relevant insofar as, as is well known, consumer protection rules only apply to consumer legal relationships, which are those in which one of the parties involved acts as a consumer vis-à-vis another who does so in a business or professional capacity. And it is not entirely clear in which cases legal persons or entities without personality deserve the attribution of consumer status.
