Same Sex Marriages in India: A Judicial Perspective
This article aims to discuss the need of recognising same-sex marriages in India. The LGBTQIA+ community has been facing ostracism from the society as well as from the government since long despite having a history of existence tracing back to the dawn of time. There have been various judgments in the past in India wherein the Courts have delivered verdicts inclined towards a more inclusive society which makes the current scenario appropriate to give marriage parity to the LGBTQIA+ community. The core of this study lies in analysing the various Supreme Court judgments, other legal precedents and evaluating various perspectives of the bench and working towards a possible solution.
