Nothing but an ankle monitor This article analyses the legal framework of electronic monitoring (EM) in the Dutch penal system in light of the requirements for a justified interference on article 8 of the ECHR. Recommendation CM/REC (2014)4 of the Committee of Ministers of the Council of Europe regarding EM is also addressed, as it elaborates on Article 8 ECHR in this context. Additionally, the article considers the methods and practical application of EM, addressing the different technologies (RFID and GPS) used in EM.
