STATUS ANAK ZINA MENURUT MAZHAB SYAFI'I DAN HAMBALI

AbstractThis study examines the legal status of illegitimate children (anak zina) according to the Syafi'i and Hambali schools of thought, a complex issue in Islamic law. An illegitimate child is defined as one born out of wedlock, as recognized by Sharia. The Syafi'i school acknowledges the lineage (nasab) of such children only from their mothers, while the Hambali school offers a more flexible approach in certain social contexts. The legal derivation methods employed by both schools include the Quran, Hadith, Ijma’, and Qiyas, differing in the acceptance of weak hadiths and the flexibility of analogies. This research emphasizes the importance of social justice and safeguarding the rights of illegitimate children, regardless of their lineage status, prioritizing public welfare (maslahah) and social equity as core principles.
