THE ROLE OF THE PRIVATE INVESTIGATOR IN CRIMINAL PROCEEDINGS
One of the most important activities in a criminal trial is the gathering of evidence. Each party to the trial tries to convince the court of the credibility of the evidence gathered in its favor. In order to effectively defend their rights, stakeholders choose trial attorneys who professionally handle the case entrusted to them in terms of legal services. Nevertheless, it is the main role of private investigators to gather evidence in a case. This study aims to show the role of the private investigator in criminal proceedings, as well as to examine whether his participation in the process can bring more positive effects or negative consequences. In addition, the article highlights some problems that arise in connection with the use of detective services. In particular, concerning: the functioning of unlicensed detectives in the service market, the realization of professional secrecy or the right to defense, as well as the problems concerning the availability of case files for private detectives. The article focuses on showing both the positive influences and the and negative repercussions of using detective services in the criminal process. The present study is primarily aimed at signaling the need for the reader to consider the possibility of, and how to eliminate, the problems posed by the participation of a detective in criminal proceedings.
