A Road Traffic Crime Situation and Its Criminal Law Meaning
The pronounced situational nature of road traffic crimes requires the identification, typification and indepth study of situations that develop in the period immediately preceding the crime and at the time of its commission. The various circumstances (factors) that form situations of a road traffic crime may have not only criminological, criminalistic, but also criminal-legal significance. Taking into account situational factors helps to resolve the issue of the presence of the criminal act itself, to establish a number of obligatory elements of the crime and, ultimately, ensures an accurate legal assessment of the event that occurred.
