Evaluation of the Proof Status When Preparing and Setting a Criminal Case for Trial
The assessment of the state of evidence in the preparation and appointment of a court session is a fundamental task of the court, on which the fairness of justice and the protection of citizens' rights depend. The effective conduct of this stage contributes to the establishment of the truth in the case, the prevention of judicial errors and the issuance of reasoned and legitimate judicial decisions. An important part of this stage is the verification of the legality of obtaining evidence and their compliance with the established requirements of the Code of Criminal Procedure. The judge must ensure that all evidence was obtained in compliance with the rights of the participants in the process and without violating criminal procedural norms.
