On Public Danger and Other Criminal Law Paradoxes
The article analyzes some paradoxes of criminal law theory and legislation due to the lack of an unambiguous legal definition and the evaluative nature of a number of basic criminal law categories used in criminal law. These include the concepts of “criminal act”, “criminality of the act”, “public danger”, “criminal liability”. In the course of the analysis, various types of criminal acts are defined and ranked depending on their content component. The ambiguity of the interpretation of the concept of “criminality of an act” used inconsistently in the criminal law is emphasized. Special attention is paid to a meaningful analysis of the category of “public danger”, the definition of new approaches and concepts characterizing it.
