Morální hazard v české právní praxi

The article analysis problem of moral hazard in Czech legal practice. The author explains current Czech Jaw regulation of several significant legal professions – judge, prosecutor, executor, notary and attorney at law – as a possible source of moral hazard. The potential causal connection between moral hazard and legal regulation of practice above mentioned professions, author see in existence of obligatory insurance and complicated process to claim damages caused by a lawyer. A lawyer knows about that insurance or complications with damages and this fact should cause eventual negligence in his decision making, because the likelihood of his financial responsibility is minimal.
