Operácie multinárodných síl a medzinárodné humanitárne právo

When exploring the topic of International Humanitarian Law (IHL) in the context of multinational forces operations, legal scholars have focused mainly on the UN, whilst other organizations have remained largely in the shadows. This Contribution focuses on the European Union (EU), holding that this regional organization – by virtue of its sui generis nature and of its increasing engagement in the field of crisis management – rises several similar questions, as have been raised in the context of the UN. The Contribution looks at the capacities of the EU and the corresponding practice, underlining the importance of the IHL for EU-led operations. Furthermore it focuses on the issues of ratione materiae and ratione personae applicability of IHL to EU operations, whereas the starting point of the analysis is that the conclusions made in the context of UN operations may not be applied automatically to EU operations because of its sui generis character.
