Problematika aplikovateľnosti noriem medzinárodného humanitárneho práva v kontexte súčasného medzinárodného práva
One of the strengths of international law is its dynamism, its capacity to develop in response to the changing realities of international life and the evolving values of the international community. Two phenomena in particular have led to astonishingly rapid developments in the substance of international law and even in the very structure of the international legal system. The first is the universal recognition that the protection of human dignity is a proper concern of international law, and the second is the accumulation and exercise of power by nonstate actors. Outline development shows particularly in those bodies of international law, such as international humanitarian law (IHL), that has as its purpose the amelioration if suffering and protection of individuals. Likewise this evolution brings the situations in which the issue of application of IHL becomes disputed. The study focuses current affairs on the field of IHL, the specific disputable character of application IHL and reflection of international law on these issues.
