Príslušníci ozbrojených síl USA a trestnoprávne stíhanie vojnových zločinov
The article focuses on the position of US armed forces within national law and the possibilities of investigation and prosecution of US soldiers for war crimes primarily at the national level. The second part of the article aims to point out that even if some amendments were recommended to be implemented in case USA became a party to the Rome Statute of the International Criminal Court, ratification of the Rome Statute would not be barred even if they were not adopted. Such a conclusion follows the institutional and material framework set down in the Rome Statute, especially within the application of the principle of complementarity.
