Intervención judicial y habitabilidad: el caso de complejo urbano Padre Mugica en Buenos Aires

Since 2020, the habitability conditions have been investigated and construction and maintenance proposals have been developed for the Padre Mugica housing complex, located in the Villa Lugano neighbourhood, Comuna 8 of the Autonomous City of Buenos Aires. The investigation arises at the request of the Public Prosecutor's Office of the Nation with the objective of contributing to the solution of a housing conflict framed in the "Mendoza Case." From the request, the need to clarify legal tools and institutional devices capable of guaranteeing the joint and participatory work of all those involved in relocation processes of inhabitants from towns and settlements is evident. With this experience, it is expected to provide bases to contribute to the search for solutions in accordance with the emerging aspects of the process as a whole that, from a participatory approach, facilitate the formulation of consensual and surpassing proposals that guarantee adequate habitability conditions. Desde el año 2020, se investigan las condiciones de habitabilidad y desarrollan propuestas de obra y mantenimiento del complejo habitacional Padre Mugica, ubicado en el barrio Villa Lugano, Comuna 8 de la Ciudad Autónoma de Buenos Aires. La indagación surge a solicitud del Ministerio Público Fiscal de la Nación con el objetivo de contribuir a la solución de un conflicto habitacional enmarcado en la “Causa Mendoza”. A partir de ella se manifiesta la necesidad de clarificar herramientas legales y dispositivos institucionales capaces de garantizar el trabajo conjunto y participativo de todos los involucrados en procesos de relocalización de habitantes provenientes de villas y asentamientos. Con esta experiencia, se espera contribuir a la búsqueda de soluciones acordes a los emergentes del proceso en su conjunto que, desde un enfoque participativo, faciliten la formulación de propuestas consensuadas y superadoras que garanticen condiciones de habitabilidad adecuadas desde un abordaje integral.
