Law Making under the Influence of Digital Technologies
The current stage of the digital technologies (DT) development allows us to judge about their significant influence on law and legislation. In this regard, it is necessary to study the possibilities of using DT in the lawmaking process. The initial stage of the use of DT in the lawmaking process can be considered the application of decision support systems, not always related to AI. The use of intelligent (AI-based) decision support systems poses more problems, as it is a larger scale replacement of human beings. The use of DH represents a new approach to the creation and implementation of new laws, also related to a more active involvement of the public through Internet technologies (crowdsourcing). The processing of big data holds special potential, but in public administration (and lawmaking among others) the use of big data raises privacy, security and ethics issues. Also, the issue of AI transparency remains in the foreground, which actualises the problem of the access to information in the context of explainable (understandable) AI.
