An administrative investigation: on practicability of existence in administrative offense laws
The author studies the procedural meaning of an administrative investigation in administrative offense proceedings based on the laws, law enforcement practice and scientific publications. The study is performed based on the interrelation between the criminal procedure and administrative offense proceedings, the content of procedural economy principles and access to justice from the territorial standpoint. It is stated that an administrative investigation fails to speed up or simplify case proceedings or create any additional efficient guarantees for the person involved in case proceedings or expand any authorities of officials in charge of case proceedings. As a result, it is suggested to remove the institution of an administrative investigation from administrative offense proceedings.
