To use other person’s property and not to return it: qualification issues
The article studies rules for qualification of criminal acts when an owner transfers the right to temporary use of property to another person, and the latter fails to return such property to the owner in the future. The act may be qualified as a theft, fraud, robbery, misappropriation or misuse depending on the time of origination of the criminal intention, means of withdrawal and (or) appropriation of other person’s property in favor of the guilty party.
