Drafted Competencies of Economic Administration in Terms of Certification of Economic Operators in Public Procurement

Certification of economic operators is a mechanism that makes participation in public tenders easier: the certificate will replace many documents that economic operators must submit during the public procurement procedure. The draft act on certification imposes a number of obligations on the minister responsible for economy, on which the proper functioning of the certification system depends. An important competence of the minister is to develop standard levels of abilities to which certificates will refer. An additional effect will be the standardization of the conditions for participation in the procurement procedure since it will reduce the number of cases in which these conditions are set by contracting authorities in a way that is disproportionate to the subject matter of the contract. The drafted provisions which provide for the minister to appoint entity certifying the absence of grounds for exclusion from the proceedings by way of an administrative agreement, should be assessed negatively.
