ON THE OPPOSITION OF A NEGATORY CLAIM AND A CLAIM FOR THE ESTABLISHMENT OF AN EASEMENT

The determination of the Judicial Collegium for Economic Disputes of the Supreme Court of the Russian Federation No. 306-ES23-26117 in case No. A65-15575/2022 on the elimination of obstacles to the use of a land plot is analyzed. A theoretically possible solution to the situation under consideration is proposed through the construction of a prescriptive easement.
